Official Plan and Development Bylaw Amendments -Public Meeting (March 19, 2024) & Information

 

Official Plan Amendment OPA-2024-01 was approved by Minister Rob Lantz on July 31, 2024.

Bylaw 2024-14-A01 to amend the Development Bylaw was approved by Minister Rob Lantz on July 31, 2024.

On April 17, 2024 Council approved and adopted the amendments to the Official Plan.

and gave first reading and approval to the amendments to the Development Bylaw.

On May 15, 2024, Council gave second reading, approved and adopted the following amendments to the Development Bylaw.

There is currently an IRAC appeal regarding the rezoning amendment 2024-14- A02.

Written comments on the proposed amendments were accepted at the Council Office until noon, Tuesday, April 2, 2024.  Email them to admin@miltonvalepark.com or delivered to the Council office at the Milton Community Hall, 7B New Glasgow Road-Rte. 224, North Milton PE C1E 0S7.

The amendments were considered at the Planning Board Meeting on Thursday, April 11 at 7 p.m.  (Please note the rescheduled date) and will be considered by the Council meetings to be held at 7:00 p.m., Wednesdays, April 17, 2024  (Official Plan and Bylaw) and May 15, 2024 (Bylaw) at the Milton Community Hall.  Please RSVP to admin@miltonvalepark.com or 902-368-3090 if you wish to attend any of these meetings.

Amendments are proposed to the Official Plan and Zoning and Subdivision (Development) Bylaw. Official Plan amendments include a change in future land use designation to Light Industrial for PID 283325 and a 1.8-acre portion of PID 658799, associated with the May 2023 proposal to change the zoning of the subject parcels in the Bylaw. Plan amendments also include clarifications to Non-Resource Commercial and Industrial and Industrial Zone policies (ss. 8.2.1 & 8.2.5), removal of subsection 9.2.3 (Excavation Pits), and minor wording changes for sections 9.2.2 and 12.8.

Proposed changes to the Development Bylaw include: administrative corrections; removal of Excavation Pits from municipal authority; addition of salvage yards to s. 4.25 (Prohibited Uses); updated pool regulations, corrections to yards and setbacks for accessory apartments, ground mounted solar arrays and PURD zone; updates to wind energy and appeal provisions to reflect provincial changes to enactments; and a new table summarizing accessory building standards.

The public can view proposed changes at the Milton Community Hall during office hours or at miltonvalepark.com and is invited to attend the public meeting and make presentations to Council. Written comments on the proposed amendments will be accepted at the Council Office until noon, Tuesday, April 2, 2024.  The amendments will be considered at the Council meetings to be held at 7:00 p.m., Wednesdays, April 17, 2024  (Official Plan and Bylaw) and May 15, 2024 (Bylaw) at the Milton Community Hall. 902-368-3090.

Most changes are administrative in nature – correcting typos, and clarifications to make the intent clearer without major changes, and updating wind energy and excavation pits as a result of Provincial changes to regulations.

Excavation Pits have been removed from the Bylaws, as the Province will regulate them; unless they are included in municipal bylaws.

After the Public meeting in May of 2023, to consider a request for rezoning and careful consideration of information presented at the meeting and received until the deadline for public comments, as well as a review and options from the municipal planner, Council intends to move forward to rezone PID 283325 from a combination of General Commercial and Agricultural to Light Industrial; and designate a 1.8-acre portion of PID 658799 from Agricultural to Light Industrial. The Future Land Use Map of the Official Plan will be updated in conjunction with this application, as well as the Zoning Map will be amended (as was the subject of the May 2023 meeting).
